Departure
Criminal Law
A judge can sentence a defendant to a term of imprisonment which is greater or lesser than the applicable sentencing range in the U.S. Sentencing Commission's sentencing guidelines if the judge concludes that a departure is appropriate. A departure from the applicable sentencing range is permitted only when the judge finds that there is an aggravating or mitigating circumstance which the Sentencing Commission has not already considered in the guidelines.
